copyright policy

§ 1. general provisions

This Copyright Policy sets out the rules for publishing and using content on the website cos.place (hereinafter the “Service”) and for reporting infringements of copyright and related rights.

The operator of the Service is COS.PLACE SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ, ul. Jana Kilińskiego 9/52, 80-452 Gdańsk, Poland, Tax ID (NIP): 9571195415, Business Registry Number (REGON): 54325148600000, National Court Register Number (KRS): 0001205415 (hereinafter the “Operator”). Contact: contact@cos.place.

This Policy applies to content posted by users, in particular photos, photo carousels, descriptions, comments, forum posts, event-related materials, profile elements, and content published by group accounts.

§ 2. rights to user content

The User retains copyright in content that they created and published in the Service. Publishing content does not transfer economic copyright to the Operator.

The User may publish only content to which they hold the appropriate rights or authorization to use and share it in the Service, including any required consents and licenses.

Publishing content with attribution to a source, author name, or co-creator does not replace obtaining the required consent from the rights holder. This also applies to fan art, anime screenshots, graphics, photographs, and other copyright-protected materials.

The User is responsible for ensuring that the content they publish complies with applicable law and the rights of third parties.

§ 3. license necessary for the operation of the service

By publishing content in the Service, the User grants the Operator a non-exclusive, royalty-free license, to the extent necessary to provide the Service, to fix, reproduce digitally, store, display, and make the content publicly available in accordance with the visibility settings selected by the User.

The license covers technical processing of materials related to the Service’s features, in particular creating thumbnails, cropping, changing aspect ratio, rotating, compressing, and displaying photos in carousels, content feeds, profiles, search results, and notifications.

The license does not authorize the Operator to sell the User’s content to third parties or to use it in advertising outside the Service without a separate legal basis.

The license remains in effect for the period during which the content is made available in the Service. After its deletion, the Operator ceases further public availability, subject to the time necessary for the technical removal of backups and cases where retention is required by law.

§ 4. photos, tags, co-creators, and the character library

The photo cropping, rotation, and aspect-ratio features do not result in the Operator acquiring copyright in the User’s materials.

A co-creator credit serves to indicate a person’s contribution to the creation of content. It does not, in itself, confirm that a license has been granted or that consent to publication has been obtained.

Tags, character names, and other labels are used to organize and search content. The availability of a label in the character library, including anime characters, does not mean that the Operator grants a license to use a character’s likeness, artwork, or other protected elements.

For jointly created content, the User should hold the rights necessary to publish it and grant the license described in § 3.

§ 5. sharing and using third-party content

The like, save, and share features within the Service do not transfer copyright in that content.

Copying, downloading, distributing, or using third-party materials beyond the scope permitted by law or authorized by the rights holder requires obtaining the appropriate permissions.

Referencing third-party works under permitted use, including the right of quotation, is allowed only within the limits arising from applicable law.

§ 6. operator content and service marks

Elements of the Service to which the Operator or its licensors hold rights, in particular original texts, graphics, interface design, and marks, are protected under applicable law.

Use of the Service does not grant the User the right to copy or commercially exploit these elements beyond the scope necessary for ordinary use of the services.

§ 7. reporting copyright infringements

A person who believes that content available in the Service infringes their copyright or related rights may submit a report to contact@cos.place.

A report should include: the reporter’s contact details; identification of the work or rights concerned; the exact URL or other information enabling identification of the disputed content; a description of the alleged infringement; and an explanation of the reporter’s authority to submit the report.

Reports are reviewed in a timely, diligent, objective, and non-arbitrary manner, taking into account applicable law, including Regulation (EU) 2022/2065 (the Digital Services Act, “DSA”), to the extent applicable.

The Operator may request additional information necessary to review the report. Reports should be submitted in good faith.

§ 8. actions taken regarding content

After reviewing a report, the Operator may, as appropriate to the circumstances and applicable law, leave the content unchanged, restrict its visibility, disable access to it, or remove it.

Where required by law, the Operator provides the interested parties with the reasons for its decision and information about available remedies.

In cases of repeated infringements, the Operator may apply proportionate measures concerning the User’s account, including restricting publishing capabilities or suspending the account, in accordance with the Terms of Service and applicable law.

The Operator is not obliged to generally monitor all User content.

§ 9. appeals and explanations

A User whose content has been removed or whose visibility has been restricted may submit an explanation or challenge the decision at contact@cos.place, identifying the content concerned and stating the reasons for the appeal.

The Operator reviews appeals in accordance with applicable law and the rules set out in the Terms of Service. Where the DSA provides for additional appeal mechanisms, the User may use them under the conditions set out in that legislation.

This Policy does not limit the right to pursue claims before a competent court or any other rights available under applicable law.

§ 10. final provisions

The Operator may update this Policy in connection with changes to the Service’s functionality or applicable law. Information about material changes will be made available in the Service.

In matters not regulated by this Policy, the applicable provisions of Polish and European Union law shall apply, in particular provisions concerning copyright and digital services.

Questions regarding this Policy may be sent to contact@cos.place.
